All guarantees and warranties are limited by: sap and soil testing performed by Eden or an Eden appointed agent; the exclusive use of Eden products and Eden application methods; adherence to all financially reasonable recommendations made by Eden; the delivery of all soil and sap test samples by overnight mailing; Growers must acquire an initial soil and plant sap test prior to any applications; Growers must acquire three additional sets of soil and plant sap tests, one each after three separate foliar and fertigation applications with a minimum of 25 gallons of clean water per acre; where foilar applications are defined whereas the entire plant is covered to a drip including the top and bottom of leaves, stems and stalks; whereas fertigation is defined as irrigation techniques through pivot, drip, flood, and floor sprinkler methods; and guarantee and warranty claims will only be valid when the soil and plant sap test exhibit absolution zero ppm change between initial and newer tests; and should such a zero improvement be presented, Eden will have the right, and user hereby agrees to allow, to send Eden representative(s) at Eden’s expense to user’s location to supply and supervise the application of one more application of Eden product(s) and the pre and post sample taking for soil and plant sap tests and should the tests exhibit zero change in ppm the user’s orders for the four test period will be reimbursed otherwise the claim will be invalid without refutation by any party.
